Detroit Lakes, Minnesota

            A special meeting of the City Council was called to order in the Council Chambers of the City Administration Building at 5:00 P.M., Tuesday, May 24, 2005, all members of the Council having been duly notified of the meeting and the business to be transacted.

 

            Present:            Mayor Larry G. Buboltz; City Administrator Richard Grabow;  Assistant City Administrator Lynne Krieger; Police Chief Kelvin Keena and Building Official Calvin Mayfield.

 

            Aldermen:         Anderson, Aune, Brenk, Hannon, Heltemes, Imholte, Tollefson, Tucker and Zeman.

           

            Absent:             City Attorney William Briggs; Finance Officer Louis Guzek;   Street Commissioner Roy Estes; Community Development Director Larry Remmen; Public Utilities Superintendent Curt Punt; City Engineer Gary Nansen; Liquor Store Manager Bradley MacMaster and Fire Chief Jeffrey Swanson.

 

            Pursuant to notice having been published in the official newspaper that the Council would, at this present meeting, conduct a hearing for the purpose of hearing public comment on the issuance of an on-sale intoxicating liquor license and Sunday on-sale intoxicating liquor license to MCW, Inc., dba Giovanni’s Pizza, 90 West Lake Drive, for the period May 24, 2005, through December 31, 2005, the Mayor called the hearing to order at 5:01 P.M.  There being no oral or written comments and after discussion by the Council, Mayor Buboltz closed the hearing at 5:02 P.M. and reconvened the regular Council meeting.

 

            Upon the recommendation of the Liquor/Gambling Control Committee, a motion was made by Alderman Aune, seconded by Alderman Brenk and carried, without a dissenting vote, authorizing the issuance of an on-sale intoxicating liquor license and Sunday on-sale intoxicating liquor license to MCW, Inc., dba Giovanni’s Pizza for the period May 24, 2005, through December 31, 2005.  Mayor Buboltz requested that the Council further review Section 702.02, Subd. 2 of the City Code requiring that any restaurant applying holding an on-sale intoxicating liquor license must have a minimum seating capacity of 90 in its formal dining area.

 

            Pursuant to the request of D-S Beverages, Inc., a motion was made by Alderman Brenk, seconded by Alderman Hannon and carried, without a dissenting vote, to approve their request to use the parking lot north of the Pavilion for prepping the Budweiser Clydesdale Hitch and allowing them to parade the horses on various City streets on June 11, 2005, as outlined in their letter.

 

            Pursuant to the review of the Fire Chief and Police Chief, a motion was made by Alderman Brenk, seconded by Alderman Tollefson and carried, without a dissenting vote, authorizing the issuance of fireworks permits to the following:

 

1)                  TNT Fireworks to sell fireworks in the WalMart Parking Lot;

2)                  White Drug to sell fireworks in the White Drug Store; and

3)                  WalMart to sell fireworks in the WalMart Store.

 

Upon the recommendation of the Liquor.Gambling Control Committee, a motion was made by Alderman Aune, seconded by Alderman Brenk and carried, without a dissenting vote, approving the following gambling applications:

 

1)                  MOC Pup Tent 9, Detroit Lakes, for gambling at the VFW; and

2)                  VFW Post 1676, Detroit Lakes, for gambling at their Club.

 

There being no further business to conduct, by general consent, the Mayor adjourned the meeting.  (5:05 P.M.)
