Minutes Special Meeting
June 16, 2005
A special meeting of the City Council was called to order in the Council Chambers of the City Administration Building at 5:00 P.M., Tuesday, June 16, 2005, all members of the Council having been duly notified of the meeting and the business to be transacted.
Present: Mayor Larry G. Buboltz; City Attorney William Briggs; City Administrator Richard Grabow and Fire Chief Jeffrey Swanson.
Aldermen: Aune, Hannon, Heltemes, Tollefson, Tucker and Zeman
Absent: Aldermen Anderson, Brenk and Imholte
A motion was made by Alderman Aune, seconded by Alderman Heltemes, to consider, for its second reading and adoption, Ordinance No. 275, an ordinance amending the City Code, Section 604.07, exempting the required surety bond for persons operating a non-motorized bicycle selling ice cream products, frozen treats and bottled water and amending City Code, Section 201.01, establishing a fee of $100.00 per license for non-motorized bicycles, selling ice cream, frozen treats and bottled water. Alderman Tucker spoke in opposition to the proposed ordinance on the basis that it is singling out one particular type of business for special treatment. Lee Kensinger, Dariy Queen, Detroit Lakes, spoke in opposition to the proposed ordinance requesting, however, if the ordinance were approved that the Council consider limiting the number of licenses that would be authorized for issuance. Bill Schwartz, 16956 Longview Lane, and Kylee Schwartz, 1311 Jackson Avenue, spoke in favor of the ordinance. A motion was made by Alderman Aune, seconded by Alderman Tollefson, to amend Section 201.01 setting the fee at $150.00. After discussion, Mayor Buboltz called the question and the amendment carried with one abstention (Hannon). A motion was made by Alderman Zeman to exclude bottled water from the ordinance but the motion died for a lack of a second. After further discussion, Mayor Buboltz called for the question on the main motion, as amended, and declared the amended motion passed for adoption of Ordinance No. 275, an Ordinance amending the City Code, Section 604.07, exempting the required surety bond and Section 201.01, setting the fee at $150.00, for persons operating a non-motorized bicycle selling ice cream products, frozen treats and bottled water. Alderman Hannon abstained from voting.
A motion was made by Alderman Heltemes, seconded by Alderman Aune and carried, with one abstention (Hannon), to approve the issuance of a Transient Merchants License to Kylee Schwartz to operate a non-motorized bicycle selling ice cream products, frozen treats and bottled water.
Pursuant to the request of Fire Chief Jeff Swanson, the motion was made by Alderman Heltemes, seconded by Alderman Aune and carried, without a dissenting vote, to authorize the purchase of a 1988 Grass Fire Truck form the City of Deerwood at a cost of $3,250.00.
Pursuant to the request of Fire Chief Jeff Swanson, the motion was made by Alderman Zeman, seconded by Alderman Tucker and carried, without a dissenting vote, to advertise for sale a 1952 Jeep.
There being no further business to conduct, and without objection, Mayor Buboltz declared the meeting adjourned at 5:35 P.M.
