ORDINANCE NO. 244    

AN ORDINANCE AMENDING SECTION 5 OF ORDINANCE NO. 5

OF THE DETROIT LAKES CITY CODE ESTABLISHING THE TERMS OF THE GOVERNING BODY OF THE DEVELOPMENT AUTHORITY

THE COUNCIL OF THE CITY OF DETROIT LAKES DOES ORDAIN AS FOLLOWS:

Section 1.  That Section 5 of the City Code be and it hereby is amended to read as follows:

            Governing Body. The powers of the Authority shall be vested in the Commissioners thereof in office at any time, a majority of whom shall constitute a quorum for all purposes.  Pursuant to Minnesota Statutes, Section 469.050, Subdivisions 3 and 4, such Commissioners shall be seven (7) in number and shall be appointed by the Mayor with the approval and consent of the Council and shall serve three-year terms.  A Commissioner of the Development Authority shall not be eligible for re-appointment after having served three consecutive three-year terms until after a lapse of one term.  Two Commissioners shall be members of the Council.  At least five (5) Commissioners shall be residents of the City.  A vacancy is created when a Council member no longer serves on the Council, when a resident Commissioner ceases to be a resident of the City, or when a non-Council member is elected Mayor or to the Council.  Such vacancy shall be filled by the Mayor, with the approval and consent of the Council, for the balance of the term.
